Terms of Service
Please read these Terms carefully before using MarLogic. By creating an account or using the app, you agree to be bound by these Terms. If you do not agree, do not use MarLogic.

1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User") and DevAndRepair ("Company", "we", "us") governing your access to and use of the MarLogic mobile application and associated services (collectively, the "Service").
By registering an account, installing the app, or using any part of the Service, you confirm that you are at least 16 years old, have read and understood these Terms, and agree to be bound by them along with our Privacy Policy.
2. Description of Service
MarLogic is a logistics management platform that enables three categories of users to coordinate shipments:
- Shippers — create shipments, declare articles, and confirm dispatch
- Drivers — accept shipment assignments, confirm article pickup, and broadcast live GPS location during transit
- Receivers — track shipments in real time via GPS and confirm receipt of articles on delivery
The Service acts as a coordination tool. DevAndRepair is not a logistics carrier or freight broker and does not take physical possession of any shipment at any time.
3. User Accounts & Roles
- You must provide accurate, complete, and current registration information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must select a single role (Shipper, Driver, or Receiver) during registration. Role changes may require re-verification.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at hello@devandrepair.com if you suspect unauthorized use of your account.
- One account per person. Creating duplicate or fraudulent accounts is prohibited.
4. Shipper Obligations
As a Shipper, you agree that:
- All article declarations (name, quantity, and declared value) must be accurate and truthful.
- You will not ship prohibited items including but not limited to: illegal goods, hazardous materials, firearms, controlled substances, or counterfeit products.
- You are solely responsible for proper packaging of all shipment contents.
- You will only assign drivers who have agreed to take the shipment through the app.
- Declared values and prices are used for record-keeping only. DevAndRepair does not provide shipment insurance.
- You accept full legal and financial responsibility for the contents of your shipments.
Shipping prohibited items may result in immediate account suspension and may be reported to relevant law enforcement authorities.
5. Driver Obligations
As a Driver, you agree that:
- You will only accept shipments you are lawfully permitted and physically capable of transporting.
- You hold all required licences, permits, and insurance required to transport goods in your jurisdiction.
- You will physically verify and confirm article counts at pickup before marking collection as complete.
- You will enable live GPS broadcasting during active shipments as required by the Service.
- You will handle all shipment contents with reasonable care to prevent damage or loss.
- You will not subcontract or transfer a shipment to another party without the Shipper's explicit consent via the app.
- In the event of damage, loss, or delay, you will immediately notify the Shipper through the app.
6. Receiver Obligations
As a Receiver, you agree that:
- You will be available to receive the shipment within the agreed delivery window.
- You will carefully inspect all articles upon delivery before confirming receipt in the app.
- Any missing or damaged articles must be flagged in the app at the time of delivery — not after the confirmation screen is dismissed.
- By tapping "Confirm Receipt", you acknowledge that all declared articles have been received in acceptable condition (unless flagged).
7. Prohibited Conduct
All users must not:
- Use the Service for any unlawful purpose or in violation of applicable regulations
- Provide false, misleading, or fraudulent information at any point
- Attempt to bypass, manipulate, or reverse-engineer the GPS tracking system
- Harass, threaten, or abuse other users through the app's communication features
- Introduce malware, viruses, or malicious code into the Service
- Scrape, crawl, or extract data from the Service without written permission
- Use the Service to coordinate the transport of prohibited or illegal goods
- Create accounts on behalf of others without their explicit consent
8. GPS & Location Use
- Drivers consent to real-time GPS location sharing with the Shipper and Receiver of each active shipment.
- GPS data is used solely for shipment tracking and is not used for advertising or sold to third parties.
- Route data is retained for 90 days for dispute resolution, as outlined in our Privacy Policy.
- Deliberately disabling or spoofing GPS during an active shipment may constitute fraud and grounds for account termination.
9. Limitation of Liability
DevAndRepair provides MarLogic as a coordination platform only. To the maximum extent permitted by law:
- We are not liable for any loss, damage, or theft of goods during shipment.
- We are not responsible for delays caused by drivers, traffic, weather, or other external factors.
- We do not guarantee the identity, qualifications, or reliability of any Shipper, Driver, or Receiver.
- Our total liability to you for any claim arising from the use of the Service shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100, whichever is greater.
- We are not liable for indirect, incidental, special, or consequential damages.
Users contract and transact with each other at their own risk. We strongly recommend verifying other parties before completing high-value shipments.
10. Intellectual Property
All content, design, code, logos, trademarks, and materials within the MarLogic application are owned by or licensed to DevAndRepair. You may not copy, reproduce, distribute, or create derivative works without our express written consent.
You retain ownership of any data you submit (shipment details, photos, etc.) and grant us a limited licence to use it solely to operate the Service.
11. Termination
We reserve the right to suspend or permanently terminate your account at any time, with or without notice, for violations of these Terms, fraudulent activity, or any reason we deem appropriate to protect the integrity of the Service or its users.
You may terminate your account at any time by submitting a deletion request via our Data Deletion page or by emailing hello@devandrepair.com. Upon termination, your access will be revoked and your data deleted in accordance with our retention policy.
12. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or use of the Service shall be resolved by good-faith negotiation first. If unresolved, disputes shall be submitted to the competent courts of the jurisdiction in which DevAndRepair operates.
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
